1. Acceptance of Terms

By installing, accessing, or using ChatGPT Q&A Collapser and Smart Outline ("the Extension," "our Extension," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Extension.

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date. Your continued use of the Extension after changes constitutes acceptance of the modified Terms.

2. Description of Service

Chat Collapse is a browser extension that enhances your ChatGPT experience by:

• Automatically collapsing and organizing Q&A rounds in ChatGPT conversations
• Providing a smart outline sidebar for easy navigation
• Offering keyboard shortcuts for efficient workflow
• Maintaining persistent state of collapsed/expanded sections (Pro feature)
• Enabling collapse/expand all functionality (Pro feature)

3. License Grant

3.1 Free Tier

We grant you a limited, non-exclusive, non-transferable, revocable license to use the basic features of the Extension for personal, non-commercial use.

3.2 Pro Subscription

Upon purchase of a Pro subscription (monthly or yearly), we grant you a limited, non-exclusive, non-transferable license to access all premium features for the duration of your active subscription.

4. Subscription Terms

4.1 Billing

• Monthly Subscription: Billed monthly at the then-current rate. Automatically renews unless cancelled.
• Yearly Subscription: Billed annually at the then-current rate. Automatically renews unless cancelled.
• All payments are processed securely through our payment provider, Creem.

4.2 Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate.

4.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation:

• You will retain access to Pro features until the end of your current billing period
• No refunds will be provided for partial billing periods
• Your account will automatically revert to the Free tier

4.4 Price Changes

We reserve the right to change subscription prices at any time. Price changes will be communicated at least 30 days in advance and will take effect at your next renewal date. Your continued use of the Extension after the price change constitutes acceptance of the new price.

4.5 Refund Policy

We offer a 30-day money-back guarantee for first-time subscribers. If you are not satisfied with your Pro subscription, contact us within 30 days of your initial purchase for a full refund. This guarantee does not apply to subscription renewals.

5. User Responsibilities

You agree to:

• Use the Extension in compliance with all applicable laws and regulations
• Use the Extension only for its intended purposes
• Not reverse engineer, decompile, or disassemble the Extension
• Not remove or modify any copyright, trademark, or other proprietary notices
• Not share your license key with others or use it on more devices than permitted
• Maintain the security of your license key and account information

6. Prohibited Uses

You may not use the Extension to:

• Violate any local, state, national, or international law
• Infringe upon or violate our intellectual property rights or the intellectual property rights of others
• Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• Submit false or misleading information
• Upload or transmit viruses or any other type of malicious code
• Collect or track personal information of others without consent
• Spam, phish, pharm, pretext, spider, crawl, or scrape
• Interfere with or circumvent the security features of the Extension
• Resell, redistribute, or sublicense the Extension without explicit permission

7. Intellectual Property

The Extension, including its original content, features, and functionality, is owned by Chat Collapse and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Third-Party Services

The Extension integrates with or operates on third-party services, including:

• ChatGPT: Owned and operated by OpenAI. We are not affiliated with or endorsed by OpenAI.
• Creem: Payment processing service. Your use of payment services is subject to their terms and conditions.

We are not responsible for the content, privacy policies, or practices of any third-party services.

9. Disclaimers

9.1 "As Is" Basis

THE EXTENSION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

9.2 No Guarantee of Availability

We do not warrant that the Extension will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from the use of the Extension will be accurate or reliable.

9.3 Third-Party Changes

The Extension's functionality depends on third-party services (like ChatGPT). Changes to these services may affect the Extension's functionality, and we are not responsible for such changes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHAT COLLAPSE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Extension
• Any conduct or content of any third party on the Extension
• Any content obtained from the Extension
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE EXTENSION EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Chat Collapse and its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from:

• Your use of and access to the Extension
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any harm caused to any third party through your use of the Extension

12. Termination

We reserve the right to terminate or suspend your access to the Extension immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of subscription fees

Upon termination, your right to use the Extension will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Chat Collapse operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Extension shall be resolved exclusively in the courts of that jurisdiction.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a formal claim, you agree to contact us at appforeveryone7@gmail.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you via email.

14.2 Binding Arbitration

If we cannot resolve the dispute informally, any dispute shall be resolved by binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Chat Collapse regarding the Extension and supersede all prior agreements and understandings.
